Array Networks has a zero tolerance policy for spam, warez, pornography, and
copyright infringement. Any accounts found to contain, promote, or link to such
content are subject to immediate removal without any form of notification or
compensation. By
selecting the "Accept" option and/or registering for and using the
services, you acknowledge
that you
have read this agreement and
agree to be bound by all terms
and conditions of this agreement. Global
Array Networks may modify any of the terms and
conditions contained in this Agreement, at any time in its sole
discretion. Any
modifications are effective upon posting of the revisions on the Global Array
Networks web site. Your
continued use of the Services following Global Array Networks's posting of any
modifications constitutes your acceptance of the modifications. If you do
not agree to the terms of any modification, do not continue to use the services
and immediately notify Global Array Networks of your termination of this Agreement at
webmaster@globalarray.net.
I.For
the purposes of this Agreement, "Global Array", "Global Array Networks", and "Auction Assist" may be used interchangeable.
II.
Global Array Networks can not be held responsible for the content hosted on its
member's pages. Global Array does not verify, check, or monitor the content
being uploaded and downloaded from its network of sites. Members are solely
responsible for their content and may be held legally responsible.
III.
Global Array Networks may terminate member accounts at any time, without notice,
for activities that violate these guidelines or for any other reason. Global
Array Networks may terminate member accounts and delete any and all member
information for conduct that is deemed harmful to the business of Global Array
Networks, or any of its partners or members. Pages found violating these items
may be subject to immediate deletion and removal from our servers without a
refund or compensation in any form, and may face permanent service refusal. The
following is a nonexclusive list of content and behaviors that are unacceptable
on the Global Array network.
a. Abuse of
the Global Array mail servers for spam or related activities.
b. Content
that condones, promotes, contains, or links to warez, cracks, hacks, their
associated utilities, or other piracy-related information, whether for
educational purposes or not.
c. Members
who use the Global Array email services for SPAM or related violations are
subject to immediate account deletion, as well as potential prosecution to the
maximum extent possible under the law.
d. Content
that contains or contains links to nudity, pornography, adult content, and/or
sex.
e. Any
activities that may inhibit or seek to inhibit our advertising abilities.
f. Content
that is racist, or otherwise extremely offensive to others, including content
which aggravates, harasses, threatens, defames, or abuses others.
g. All web
pages must be accessible to the Internet community at large.
h. Sites
that exploit images of children less than 18 years of age.
i. Content
that contains, links to, or participates in pyramid schemes, gambling, raffles,
lotteries, and so forth.
j. Content
that posts or discloses personal identification information or private
information of individuals under the age of 13 or in connection with materials
directed toward individuals under the age of 13 without verifiable
parental consent.
k. Content
that provides, sells, or offers to sell the following: controlled substances,
illegal drugs and drug contraband, alcohol, weapons, pirated materials,
pornography or sexual products, programs to attack others, illegal goods,
instructions on making, assembling, or obtaining illegal goods or weapons,
information used to break copyright or trademark violations, to destroy others'
property, or to harm any people or animals.
IV. Global
Array Networks provides space for hosting files, but makes no implied or expressed
warranties about the reliability of this space or related services. Global
Array is not responsible for any deletion, alteration, or loss of data due to
network or system outages, file corruption, accidental deletion, or any other
reasons.
a. Users
are responsible for regularly monitoring and creating backups of their own
files, and agree to use the Global Array network resources and infrastructure
at their own risk. Neither Global Array, its owners, nor its partners make
warranty with respect to any
content, information, services, or products provided through or in conjunction
with this service.
b. Global
Array, its owners, and its partners make no guarantee of the accuracy,
correctness, or completeness of any information on these web pages and are not
responsible for any errors or omissions arising from the use of such
information; any failures, delays, or interruptions in the delivery of any
content or services contained on our servers; or losses or damages arising from
the use of the content or services provided by Global Array Networks.
c. Global
Array may also link to or include on its web site resources and information
provided by third-party partners and providers. We do not guarantee the
reliability of this information, nor does the inclusion of this information
imply our recommendation of these services; it is merely provided as
assistance.
d. You
agree to indemnify Global Array Networks, its owners, and its partners against
any and all claims and expenses, including attorneys' fees, arising from your
use of this service. This expressly includes your responsibility for any and
all liability arising from the violation or infringement of proprietary rights
or copyrights and any libelous or unlawful material contained within your web
site.
VI. FTP
access. FTP access is provided for the purposes of uploading content, maintaining content,
and downloading content for backup purposes only. It is not to be used for the
distribution of files.
VII. Refund
and Disputes. All payments to Global
Array Networks are nonrefundable. This includes any applicable setup fees
and subsequent charges regardless of usage. All overcharges or billing
disputes must be reported within 30 days of the time the dispute
occurred. If you dispute a charge to PayPal that, in Global Array
Networks's sole discretion is a valid charge under the provisions of this
Agreement, you agree to pay Global Array Networks an "Investigation
Fee" of $10.00.
VIII.
Domain Names. Upon registering your domain
name, you are bound by the terms of the registration service's then current
domain name policy and the policies of the national DNS registration
authorities. Global Array Networks will not refund any fees you paid with
regard to the registration of a domain name you are unable to use. Accounts involving new domains will be registered,
set up, and entered into DNS servers within 1 to 5 business days following receipt of payment. Due
to unanticipated complications, this process may sometimes require up to 10
business days.
IX: Bandwidth
Usage. Global
Array Networks reserves the right to limit bandwidth usage.
X.
Global Array Networks reserves the right to discontinue service at anytime without
issuance of any refund.
